Whereas, the Town Board of the Town of West Seneca has received a request for a special use permit for the following described property from its classification of C-2 to C-2(S) for the sale of motor vehicles.

Now, therefore, be it resolved, that a special permit be granted and the same is hereby rezoned from C-2 to C-2(S) permitting the sale of motor vehicles.

Be it further resolved that the Town Clerk is hereby ordered and directed to make such change on the zoning map and to enter a copy of this resolution with the zoning regulations in a book appropriate for its use.

Proposals must be received in the Town Clerk’s Office, 1250 Union Road, West Seneca, New York, by 2:00 P.M. on November 4, 2011 for acceptance by the Town.

REQUEST FOR PROPOSAL FOR SECURITY CAMERAS AT THE BURCHFIELD NATURE AND ART CENTER AND TOWN OWNED BUILDING AT HARLEM ROAD PARK, SUNSHINE PARK AND 39 SOUTH AVENUE

A. Notice is given that the Town of West Seneca, a New York Municipal Corporation (hereinafter referred to as Town or Buyer) is hereby seeking requests for proposal for the purchase, installation and service of security cameras at the Burchfield Nature and Art Center and Town owned buildings at Harlem Road Park, Sunshine Park and 39 South Avenue.

1. The Town of West Seneca is seeking bids to furnish and install security cameras which provide complete perimeter coverage of Town owned buildings at the Burchfield Nature and Art Center and Town owned buildings at Harlem Road Park, Sunshine Park and 39 South Avenue.

2. The security cameras shall be the type that run and record continuously, with date and time-stamping capability.

3. The security cameras shall be capable of recording on site as well as being broadcast remotely to the Town’s public safety dispatch center located at 1250 Union Road, West Seneca, N.Y. 14224.

4. The on-site recording shall have sufficient storage to allow for 72 hours of stored material.

5. The bid shall include a three year maintenance and service agreement.

B. Contract and Term:

Each bidder shall submit with its proposal a copy of its standard form contract which it proposes to utilize for the services stated above By submitting a proposal, each agrees that in the event its standard form contract conflicts with the specifications herein set forth, such contract shall be amended to conform to the specifications and provisions herein.

C. Monthly Invoicing and Payment:

The bidder shall invoice the Town on a quarterly basis for the maintenance and service agreement utilizing the Town’s voucher process.

D. Qualifications for Submitting a Proposal:

The Town reserves the right to conduct any investigations or due diligence necessary to verify information submitted by anyone who submits a proposal and to determine their capability to fulfill the terms and conditions of the request for proposal.

Any party submitting a proposal represents and warrants that he or she is capable and qualified in performing the services described above. Any party submitting a proposal shall include with its proposal an outline of his or her relevant experience in completing the project outlined above.

Any party submitting a proposal shall submit a completed “Statement of Bidder’s Qualifications” Exhibit A hereto, which shall accompany the submitted bid.

E. Method of Award:

The contract shall be awarded at the full and exclusive discretion of the Town subject to the provisions hereof to the selected bidder. Buyer may reject any and all bids at its discretion for any reason. The Town reserves the right to award the contract within two weeks (2) after the opening date of the sealed proposals.

The Town in its absolute discretion, reserves the right to award no contract hereunder to any individual who submits a proposal and reserves the right to reject any and all proposals.

F. Assignment and Subcontracting:

The successful bidder shall not assign, transfer, subcontract, or otherwise dispose of the contract, or any part thereof, or any right, title or interest hereunder without the prior written consent of the Town. Any assignment or attempted assignment contrary to the provisions hereof is void, any purported assignee shall acquire no rights hereunder, and the Town shall have no obligation to recognize any such assignment or attempted assignment.

G. General Provisions:

An individual who submits a proposal may not take advantage of any errors or omissions in the proposal process. The Town reserves the right to reject any and all proposals on any and all items in the proposal, even if its actions result in a failure to award the project, and to waive any provisions set forth in these specifications.

Each proponent, by submitting a proposal, irrevocably agrees that if it is determined to be the successful proponent by the Town, such individual shall, within 3 business days hours of notification from the Town that it is the successful proponent, execute and deliver to the Town a contract (in the form submitted with its bid) for the performance of the services stated above. NOTICE IS HEREBY GIVEN that the Tax Roll and Warrant for the School taxes for the Town of West Seneca, for the year 2011 was received by me on September 9, 2011 and that all persons and corporations named therein are required to pay their taxes at my office at the West Seneca Town Hall, 1250 Union Road, West Seneca New York on or before the 17th day of October 2011 and when so paid shall be received with no additions or penalties. Penalties will be added after that date pursuant to Chapter 812 of the Laws of 1942 as amended. On all taxes paid between October 18th and October 31st 7.5% shall be added. If paid between November 1st and November 30th, 9.0% shall be added. Taxes that are unpaid after November 30th will be returned to the County and added to the 2012 County Tax Roll.

1. Sealed bids in duplicate for the construction of the 2009/2010 EXCEL Project Phase 2 in the West Seneca Central School District will be received at West Seneca Central School District Offices, 1397 Orchard Park Road, West Seneca, New York 14224 until 2:00 P.M. local time, on October 20, 2011 and then at that place, date and time publicly opened and read aloud.

5. Qualification of Bidders:

A. The Owner may make such investigation as he deems necessary to determine the responsibility of any bidder to perform the work.

B. Bidders shall furnish to the Owner the information and data required, including complete financial data, within the time, in the form and in the manner required by the Owner.

C. The Owner reserves the right to reject any bid, and to disqualify the bid, if the evidence submitted or investigation of any such bidder fails to satisfy the Owner that such bidder is responsible, or is able or qualified to carry out obligations of the Contract or to complete the work as contemplated therein.

6. The Owner reserves the right to waive any informality in or to reject any or all bids.

7. All bidders shall submit with their quotations, acceptable bid security in the amount of ten (10) percent of their bid.

8. Successful bidders shall provide Owner with performance and payment bonds in the prescribed form and with an acceptable security, in accordance with the Supplementary Instructions to Bidders.

9. All bidders will be required to execute the bid proposal certifications on the prescribed form as attached to the bid form.

C. A non-refundable $20.00 per set payment is required to cover the cost of shipping and handling. Separate checks shall be made payable to Cannon Design.

11. All bidders who have paid the aforesaid deposit, and who return such sets to the Architect in good condition within ten (10) calendar days after the opening of bids, shall receive a refund in the full amount of their deposit. Any prime contractors who do not submit bids, upon so returning such sets, within ten (10) calendar days after the opening of bids, will be refunded one-half of the deposit. At the end of required time, it is understood that the contractors shall automatically forfeit the entire amount of their deposit.
